These Terms and Conditions ("Terms") govern your use of the Spike AI mobile application ("the app," "we," "our," or "us"). By downloading, installing, or using Spike AI, you agree to be bound by these Terms. If you do not agree, do not use the app.
1. Eligibility
You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to create an account and use Spike AI. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the app. By using Spike AI, you represent and warrant that you meet these eligibility requirements.
2. Account Registration
To use Spike AI, you must create an account using one of the following methods: email with magic link (passwordless), Apple Sign-In, or Google Sign-In. You are responsible for maintaining the security of your account credentials and the devices linked to your account. You agree to provide accurate information and to notify us promptly if you suspect unauthorized access to your account.
3. Description of Service
Spike AI is a personal productivity and focus application that provides:
- Task and goal management: Create, schedule, prioritize, and track daily tasks and long-term goals.
- Focus modes: Four levels of app-blocking intensity (Chill, Focus, Lock-In, and Sweat) that use Apple's Screen Time APIs to help you manage distracting apps.
- Sweat Mode: A feature that uses on-device camera-based body pose detection to count physical exercises (push-ups and stand-ups) in exchange for temporary app access.
- Progress tracking: Streaks, daily consistency, screen time trends, milestones, and achievement badges.
- AI-powered weekly summaries: Automated productivity narratives generated from your usage data.
- Notifications and reminders: Customizable reminders, daily motivational quotes, and goal deadline alerts.
- Live Activities: Real-time progress display on your Lock Screen.
4. Intended Use and Limitations
Spike AI is designed exclusively to support personal productivity and intentional device use. It is not a medical, mental health, therapeutic, emergency, safety, parental control, child monitoring, employment monitoring, or device management service. You acknowledge that:
- Focus modes and app blocking depend on Apple's Screen Time frameworks and may not function in all circumstances due to iOS updates, permission changes, device restarts, or other system-level factors.
- Sweat Mode uses on-device machine learning for body pose estimation, which may not be 100% accurate. Detection quality depends on lighting conditions, camera angle, body positioning, clothing, and device placement. Spike AI does not guarantee that every repetition will be detected correctly.
- AI-generated weekly summaries are produced by automated systems and are intended for personal reflection only. They should not be relied upon as professional advice.
- Notifications, reminders, and Live Activities depend on iOS system behavior, device settings, and connectivity, and may not always be delivered as expected.
Do not rely on Spike AI in any situation where the failure of a reminder, app block, camera check, notification, or network request could cause harm.
5. Your Responsibilities
When using Spike AI, you agree to:
- Choose focus mode settings appropriate for your situation and review your app selections before activating a mode.
- Deactivate focus modes when they no longer match your needs.
- Grant only the iOS permissions you are comfortable with (Screen Time, camera, notifications).
- Avoid entering sensitive personal information (financial, medical, or confidential data) into task names or goal descriptions.
- Comply with all applicable laws, regulations, and Apple's App Store terms.
6. Acceptable Use
You agree not to:
- Use Spike AI for any unlawful, abusive, deceptive, or harmful purpose.
- Attempt to circumvent, disable, or interfere with the app's security features, focus mode restrictions, or exercise detection mechanisms.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app.
- Use automated systems to overload, disrupt, or abuse the backend services.
- Interfere with another person's device, account, or use of the app.
- Misrepresent your identity or impersonate another person.
7. Intellectual Property
All content, features, and functionality of Spike AI, including but not limited to the user interface, design, code, graphics, logos, motivational quotes, and AI-generated summaries, are owned by Spike AI and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial purposes in accordance with these Terms.
8. User Content
You retain ownership of the content you create within Spike AI, including task names, goal descriptions, and profile information. By using the app, you grant us a limited license to store, process, and display this content solely to provide the service to you, including generating AI-powered summaries from your productivity data.
9. iOS Permissions and Platform Dependencies
Certain features require iOS permissions, including Screen Time (Family Controls), camera access, notification delivery, and Live Activity support. These permissions are governed by Apple's operating system and may be affected by iOS updates, device settings, system restrictions, or connectivity. We are not responsible for changes in Apple's platform behavior that affect feature availability.
10. Privacy
Your use of Spike AI is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. By using the app, you consent to the practices described in our Privacy Policy.
11. Account Suspension and Termination
You may delete your account at any time from the Profile tab within the app. Account deletion permanently removes your authentication account and all associated data from our servers, including tasks, goals, focus records, progress summaries, and profile information.
We reserve the right to suspend or terminate your access to Spike AI if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent or abusive behavior, or if required by law or platform rules.
12. Disclaimer of Warranties
Spike AI is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Spike AI and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of productivity, loss of profits, or personal injury, arising out of or related to your use or inability to use the app, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claims arising from these Terms or your use of the app shall not exceed the amount you paid for the app (if any).
14. Indemnification
You agree to indemnify, defend, and hold harmless Spike AI and its developers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the app, your violation of these Terms, or your violation of any rights of a third party.
15. Changes to These Terms
We may update these Terms from time to time as the app evolves or as required by law. The "Last updated" date at the top of this page indicates the most recent revision. Continued use of Spike AI after changes are posted constitutes your acceptance of the updated Terms. If we make material changes, we will make reasonable efforts to notify you through the app or by other means.
16. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Spike AI shall be resolved in accordance with applicable dispute resolution procedures.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
18. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Spike AI regarding your use of the app and supersede any prior agreements or understandings.
